The Kerala high court on Tuesday directed the government to issue bar licences to 21 hotels which upgraded their facilities and obtained four-star classification.
Justice K Surendra Mohan issued the directive while considering petitions moved by the hotel owners through senior counsel C C Thomas.
The petitioners had pointed out that they had built their hotels according to four-star classification after obtaining project approvals from the ministry of tourism and the state government. When the petitioners applied for four-star rating, it was declined for want of bar licence. They, however, obtained three-star classification and got FL-11 licence (licence for selling beer and wine). On the basis of the FL-11 licence, which is treated as a bar licence, they got upgradation to four-star rating.
As the high court has modified the revised abkari policy to the extent that four-star hotels are eligible for bar licences, and as there is no stay on the single bench's order, they are entitled for bar licences, the hotels owners had contended.
Allowing the petitions, the court asked the government to consider their applications for bar licences if they meet other eligibility criteria.
