A magisterial court summons to top Indian executive of an US multinational firm, owning popular KFC and Pizza Hut outlets, to answer charges of running a fast food eatery here without licence, has been quashed by a session court.
Additional Sessions Judge (ASJ) Rajeev Bansal quashed the summons to India Managing Director Niren Chaudhary of US-based Yum! Brands,
which owns food chains KFC and Pizza Hut, saying the trial court order summoning the top executive cannot be "sustained in law" at this juncture. ASJ Bansal's gave his order on Chaudhary's plea against the magisterial court's January 2011 order summoning him. In his plea, Chaudhary had contended that he was summoned by the court despite the police booking only the manager of a KFC outlet, based at a South Delhi mall, on charges of running the food joint without proper licence. The sessions court held Chaudhary could not be summoned "at this stage" of inquiry since no additional evidence had surfaced and the lower court could proceed only against Bhupender Singh Negi, the KFC outlet manager.
